I knew some people who regularly smuggled Kinder eggs a while ago. Not for the money, but just because, why not, if you're going to and from Canada all the time?

Which exists because Americans are apparently too stupid not to choke on the toy in the chocolate egg. Citing the law doesn't change this, you're just saying the same thing in different words.

Indeed. But this sort of thing is an unintended consequence of a poorly worded law. Such things are hardly a rare occurrence.

There are even weirder things, like the Norway-Sweden Onion/Garlic smuggling rings which operate by truckloads. Sweden is in the EU so it has to buy foods from EU markets. Norway does not, so it buys cheap Garlic from China. Add to this a huge market in Sweden and a long border without much controls and you have a paradise for smugglers.

http://www.accessdata.fda.gov/cms_ia/importalert_107.html

*** Import Alert 34-02 was created as the Agency was made aware of a product called "Kinder Surprise Eggs", and similar articles containing imbedded, non-nutritive objects, being offered for sale in the United States. The imbedded non-nutritive objects in these confectionary products may pose a public health risk as the consumer may unknowingly choke on the object. ***

Section 402(d)(1) of the Federal Food, Drug, and Cosmetic Act provides that confectionery having partially, or completely imbedded therein, any non-nutritive object is adulterated unless FDA has issued a regulation recognizing that the non-nutritive object is of practical functional value to the confectionery product and would not render the product injurious or hazardous to health.

*** Districts may detain, without physical examination, the indicated products from the firms identified on the Red List of this Alert. ***

Oh, and just to note: this is the MOST RECENT addition to the ban list, created because of cross-shipment of Kinder Surprise Eggs through Poland with Polish labeling. They've been banned for YEARS.

With every passing year, countries look more and more similar.
