Anonymous 03/16/14(Sun)12:26 UTC+1 No.637036 Report

A cyclist crashed into my motorcycle this morning after he ran a red light, I was doing a steady 30mph and the guy claims I should have stopped for him. I saw him emerging but thought he was going to swerve behind me. Am I liable? I'm not much of an expert on bicycles but it looked like a pretty expensive road bike, the front wheel hit my exhaust guard, got ripped to shreds and the forks broke clean off where they join the frame (it looked like carbon fiber). Luckily, he just hit the road and bloodied his nose (no helmet).

I have his name address and he has mine.
He seemed pretty certain I was in the wrong, I didn't make the mistake of apologising or admitting liability. He also declined an ambulance, the police or a taxi (he had no phone).

>no witnesses recorded
He doesn't have a case. Just ignore his calls.

fuck off, just cause you're too cool to mount brakes on your bike doesn't give you special rights in traffic.

If the guy got hurt then cops should have been called then and there. That's how it works in my town anyway. Regardless, if they guy ran the light and ran into you, it's pretty clear who fucked up.

>people who make mistakes in traffic deserve to be punished by injury or death.

That's not how it works. If OP could have averted the collision but didn't, he's partially responsible for it.
>>
Anonymous 03/16/14(Sun)13:48 UTC+1 No.637060 Report

If he ran a red, then it his fault. Bicycles are subject to the same rules as motor vehicles.

This is a clear liability, same as running up someone's rear. And to top it off, the bicycle crashed into the motorcycle, a clear liability for the cyclist.

I have to agree with most people here. Although, for your sake, I would have called the police when it happened. If he decides to take legal action it will come down to your word against his without any recorded evidence by the police. Chances are it won't matter, nothing will come of it, but as general advice whenever anything like this happens you should get the police involved to cover your own ass, if anything. Also, that way, if he would have somehow damaged your bike you could seek reparations.

Go to the cops and report an incident before he does, only in his version it will be you who ran a red.

This. Calling the police right then is the best idea, as well as grabbing some witnesses who can attest to your green light and the cyclist's red light if anyone is willing to stick around.

red lights don't apply to cyclists, only things with engines

It's like the Darwin awards - he literally needs to be punished by injury or death.

You're not liable in any way -- it's not your job to make sure other people don't break the laws. If he is harassing you, I would bring it to the police first, at least in order to stop the harassment. You might also get a settlement from him.

As much as I want to hit that cyclist with my 25lbs steel bike, I have to say yes, you're at fault. Well at least on most countries' road laws

Actually, that is how it works. That's why we have these safety measures in place. One could take a moral stance and say that if OP could have prevented it he should have, but he didn't have a legal obligation to do so.

>>637081
Do this immediately. Why didn't you call right then? Just curious. It always makes sense to call the police after ANY road accident, even if it's minor. A written, legal document with an account of the accident will only benefit the honest party.

If you're in England you're in serious trouble for failing to report an accident. There is a report time-window. I'd report it to the police NOW because you were stupid enough to let him take your plates.
